Legal Agreement

These Terms and Conditions constitute a binding legal agreement between you (the "User" or "Student") and WealthPath Academy (the "Company," "we," "us," or "our"). By accessing our website, enrolling in our courses, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1.3 Age Requirements: Confirm that you are at least 18 years old or have obtained parental/guardian consent if you are a minor.

1.4 Financial Obligations: Pay all fees and charges associated with your course enrollment in a timely manner.

2. Prohibited Activities and Behaviors

You expressly agree not to engage in any of the following prohibited activities:

  • Violating any intellectual property rights, including copyright, trademark, or patent rights
  • Transmitting unlawful, harassing, defamatory, abusive, threatening, or harmful content
  • Impersonating any person or entity or misrepresenting your affiliation with any person or entity
  • Interfering with or disrupting our services or servers connected to our services
  • Engaging in any form of automated data collection, including web scraping or data mining
  • Using our platform for any commercial purpose without our express written consent

3. Indemnification Obligations

You agree to indemnify, defend, and hold harmless WealthPath Academy, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

  • Your use or misuse of our services
  • Your violation of these Terms and Conditions
  • Your violation of any third-party rights
  • Any unauthorized or prohibited use of our platform

4. Privacy and Data Protection

You acknowledge and agree that:

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEALTHPATH ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

Your access to or use of (or inability to access or use) our services

Any conduct or content of any third party on our services

Any content obtained from our services

Unauthorized access, use, or alteration of your transmissions or content

Maximum Liability: In no event shall our total liability to you for all damages exceed the amount you paid to us in the twelve (12) months preceding the claim, or ¥50,000, whichever is less.

7. Educational Content Disclaimer

WealthPath Academy provides educational content about finance and investment topics. You acknowledge and agree that:

Our courses are for educational purposes only and do not constitute financial, investment, or legal advice

We do not guarantee any specific financial outcomes or investment returns from applying course concepts

All investment and financial decisions carry inherent risks and should be made based on your individual circumstances

You should consult with qualified professionals before making any financial or investment decisions

Past performance examples or case studies do not guarantee future results

8. Force Majeure

WealthPath Academy shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labor disputes, governmental actions, internet service failures, or any other unforeseen circumstances that make performance commercially impracticable.

Legal Information and Dispute Resolution

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or related to these Terms or your use of our services shall be instituted exclusively in the courts of Tokyo, Japan, and you consent to the personal jurisdiction of such courts.

10. Dispute Resolution Procedures

In the event of any dispute arising from these Terms, the parties agree to the following resolution procedure:

Step 1: Informal Resolution

Contact us directly to attempt to resolve the dispute informally. We commit to working with you in good faith to reach a mutually acceptable solution.

Step 2: Mediation

If informal resolution fails, the parties agree to participate in mediation before pursuing formal legal action. Mediation costs shall be shared equally.

Step 3: Legal Action

Only after exhausting informal resolution and mediation may either party pursue legal remedies through the courts specified in the Governing Law section.

11. Severability Clause

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

12. Terms Modification Policy

We reserve the right to modify or update these Terms and Conditions at any time. Changes will be effective upon posting to our website with an updated "Effective Date."

Material changes will be communicated via email to registered users

Your continued use of our services after changes are posted constitutes acceptance of the modified terms

If you do not agree to modified terms, you must cease using our services

13. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other legal notices published by us on our services, constitute the entire agreement between you and WealthPath Academy concerning your use of our services.

These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and us regarding the subject matter of these Terms.

You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction. Any attempted assignment or transfer in violation of this provision shall be null and void.
